Delay, Disruption and Acceleration Claims
This course will help participants learn how to avoid delay claims and constructive acceleration claims in Public Construction Contracts.
The goal of this course is to help participants ensure that relationships among the City, contractors, and designers will not be negatively affected by disputes, claims, abandonment, or termination resulting from delays. This course will provide an overview of "time" related contractor claims in public works construction contracting. We will cover the basics of delay, disruption, and acceleration, including the kinds of delay defined by Public Works’ general conditions (unavoidable, avoidable, compensable, non-compensable, and concurrent.) We will examine basic scheduling concepts and contract requirements; allowable damages, including field office, home office, idle equipment, and liquidated damages; allowable theories of proof, including total cost, modified total cost, measured mile, and jury verdict.
Participants will be provided with the following: outlines and summaries of all of the above topics and a tip sheet on how to avoid claims and/or achieve early claim resolution.

Louise Simpson is a Deputy City Attorney with the San Francisco City Attorney’s Office. She has been with CAO for 25 years and has been on the construction team for 20 years. Louise has provided council to San Francisco Public Works for over 20 years and has been providing training on construction contracts for Public Works employees for over 15 years.
